अयोध्या राम जन्मभूमि मामले पर आ सकता है अहम फैसला
नई दिल्ली । सुप्रीम कोर्ट इस बात पर फैसला देगा कि मस्जिद में नमाज पढऩा इस्लाम का आतंरिक हिस्सा है या नहीं. इस बात पर फैसला सुनाने के बाद ही टाइटल सूट के मुद्दे पर फैसला आने की संभावना है। 1994 में सुप्रीम कोर्ट की पीठ ने फैसला दिया था कि मस्जिद में नमाज पढऩा इस्लाम का इंट्रीगल पार्ट नहीं है, इसके साथ ही राम जन्मभूमि में यथास्थिति बरकरार रखने का निर्देश दिया गया था, ताकि हिंदू धर्म के लोग वहां पूजा कर सकें। अब कोर्ट इस बात पर विचार करेगा कि क्या 1994 वाले फैसले की समीक्षा की जरूरत है या नहीं। कोर्ट ने 20 जुलाई को फैसला सुरक्षित रखा था। बता दें कि टाइटल सूट से पहले ये फैसला काफी बड़ा हो सकता है। सुप्रीम कोर्ट की एडवांस सूची के मुताबिक ये फैसला लिस्ट में शामिल है। गौरतलब है कि 1994 के फैसले में पांच जजों की पीठ ने कहा था कि मस्जिद में नमाज पढऩा इस्लाम का इंट्रीगल पार्ट नहीं है। 2010 में इलाहाबाद हाईकोर्ट ने फैसला देते हुए एक तिहाई हिंदू, एक तिहाई मुस्लिम और एक तिहाई रामलला को दिया था।
2 अक्तूबर से पहले सुप्रीम कोर्ट सुनाएगा 8 बड़े फैसले-देश के मुख्य न्यायाधीश दीपक मिश्रा दो अक्तूबर को रिटायर होने वाले हैं लेकिन उससे पहले वह आठ बड़े फैसले देने वाले हैं जिनका देश और समाज पर निश्चित रूप से बड़ा असर होगा। अगर बीते दो दशकों की बात करें तो दीपक मिश्रा पहले ऐसे सीजेआई हैं जिन्होंने सबसे ज्यादा संवैधानिक पीठों की अध्यक्षता की है। जस्टिस दीपक मिश्रा की ओर से दिये गये फैसलों ने देश के राजनीतिक, सामाजिक, आर्थिक और धार्मिक क्षेत्रों में व्यापक असर डाला है। हाल ही में धारा 377 को लेकर जो बड़ा फैसला आया था वह भी जस्टिस दीपक मिश्रा के नेतृत्व वाली पीठ ने ही दिया था। अब 2 अक्तूबर से पहले जो फैसले आने हैं उसमें आधार की अनिवार्यता से लेकर अयोध्या विवाद तक शामिल हैं। इसके अलावा केरल के सबरीमाला अय्प्पा मंदिर में महिलाओं के प्रवेश तथा सरकारी नौकरियों में एससीध्एसटी वर्ग को प्रोन्नति में आरक्षण और राजनीति से अपराधियों को दूर करने जैसे महत्वपूर्ण मामले शामिल हैं। यही नहीं इस मामले पर भी फैसला आना है कि क्या सांसद और विधायक रहते हुए कोई व्यक्ति अदालतों में प्रैक्टिस कर सकता है। इसके अलावा आईपीसी की धारा 497 पर भी फैसला आना है जिसमें एक विवाहित पुरुष को अकेले ही दोषी माना जाता है जब वह किसी अन्य विवाहित महिला से उसके पति की अनुमति बिना सेक्स संबंध बनाता है। अभी तक इस धारा के तहत महिला को बख्श दिया जाता है जबकि वह भी इस अपराध में बराबर की भागीदार होती है।
