नयी दिल्ली । उच्चतम न्यायालय ने सोमवार को बंबई उच्च न्यायालय से कहा कि वर्ष 2008 के मालेगांव विस्फोट मामले के आरोपियों में से एक लेफ्टिनेंट कर्नल प्रसाद श्रीकांत पुरोहित की याचिका पर वह विचार करे। उस याचिका में पुरोहित ने कहा है कि उनके खिलाफ मुकदमा बिना किसी वैध अनुमति के चलाया जा रहा है। प्रधान न्यायाधीश रंजन गोगोई की अध्यक्षता वाली पीठ ने उच्च न्यायालय को पुरोहित की याचिका पर 21 नवंबर को सुनवाई करने का निर्देश दिया। मालेगांव विस्फोट मामले में विशेष अदालत ने दो नवंबर को पुरोहित, साध्वी प्रज्ञा सिंह ठाकुर और पांच अन्य आरोपियों के खिलाफ आरोप तय करने के बाद औपचारिक रूप से मुकदमा शुरू कर दिया था। पुरोहित ने अपनी याचिका में शीर्ष अदालत के पहले के आदेश का जिक्र किया था जिसमें निचली अदालत और बंबई उच्च न्यायालय को पुरोहित के दावे पर विचार करने का निर्देश दिया गया था। उसमें कहा गया था कि उनके खिलाफ गैरकानूनी गतिविधियां (रोकथाम) अधिनियम तथा अन्य दंडात्मक कानूनों के तहत अधिकारियों से मंजूरी के बगैर मुकदमा चलाया जा रहा है। याचिका में आरोप लगाया गया कि निचली अदालत ने मंजूरी नहीं लेने के दावे को देखे बगैर ही पुरोहित और अन्य के खिलाफ आरोप तय किए और मुकदमा शुरू कर दिया।
